This Privacy Policy Agreement (“Agreement”) is made and entered into by and between Baleh Consulting Pty Ltd (hereinafter referred to as “Baleh Consulting”) and Client (hereinafter referred to as “Client”), effective as of 01/07/2024.
1. Preamble
Baleh Consulting is committed to protecting the privacy of its Clients and the security of their data. This Agreement outlines the manner in which Baleh Consulting collects, uses, discloses, and protects Client data in the context of Baleh Consulting’s services mainly, but not limited to, in the concrete waterproofing below ground for both new and existing structures.
2. Data Collection
The specific data Baleh Consulting collects from Client will depend on the nature of the consulting services provided. Here’s a breakdown of potential data categories:
- Name
- Company name
- Title
- Email address
- Phone number
- Physical mailing address (for report delivery)
- Project name
- Location
- Type of structure (residential, commercial, etc.)
- Size and scope of the project
- Relevant building drawings and specifications
- Site investigation reports
- Geotechnical reports
- Consultants’ specification reports
- Laboratory testing results
- Photographs (including before, during, and after construction stages for new structures, or highlighting areas of concern for remedial projects)
- Material safety data sheets (MSDS) for waterproofing and repair materials
- Drone footage (if applicable for large or complex projects)
In some cases, with Client’s prior consent, Baleh Consulting may collect limited personal data from building occupants or other stakeholders involved in the project. This may include names and contact information for scheduling inspections or obtaining access to relevant areas of the building. Baleh Consulting will treat this data with the same level of care and security as Client data.
3. Data Use
Baleh Consulting will use Client data only for the following purposes:
- To provide the agreed-upon consulting services to Client
- To prepare comprehensive reports, including recommendations and justifications
- To communicate effectively with Client regarding project progress, findings, and next steps
- To comply with all applicable laws, regulations, and building codes
- To maintain a record of services provided for internal business purposes (e.g., project portfolio, client history)
- To provide anonymised data for industry research or educational purposes (only with Client’s explicit consent)
4. Data Disclosure
Baleh Consulting will maintain the confidentiality of Client data and will not disclose it to any third party without Client’s prior written consent, except in the following limited circumstances:
- Subcontractors or Consultants: To subcontractors or consultants engaged by Baleh Consulting to assist with the project, who will be bound by strict confidentiality agreements. Baleh Consulting will only share the minimum amount of data necessary for them to perform their designated tasks.
- Legal Requirements: As required by a court order, subpoena, or other legal process.
- Safety or Public Interest: In situations where Baleh Consulting has a good faith belief that disclosure is necessary to protect the health or safety of others, or to prevent imminent harm to property.
- Merger or Acquisition: In the event of a merger, acquisition, or other business transaction involving Baleh Consulting, Client data may be transferred to the successor entity, provided such entity agrees to comply with the terms of this Agreement.
5. Data Security
Baleh Consulting takes all reasonable steps to protect Client data from unauthorised access, disclosure, alteration, or destruction. These measures may include:
- Secure Storage: Secure storage of electronic data on password-protected servers at rest and in transit.
- Data Backups: Regular backups of data to ensure disaster recovery.
- Access Controls: Implementation of access controls to restrict access to data only to authorised personnel with a legitimate business need.
- Employee Training: Employee training on data privacy and security best practices.
- Incident Response: Maintaining an incident response plan to address data breaches and security vulnerabilities.
6. Client Rights
Client has the following rights regarding their personal data held by Baleh Consulting:
- Right to Access: Client can request a copy of their personal data at any time. Baleh Consulting will provide this information in a clear and accessible format.
- Right to Rectification: Client can request that Baleh Consulting update or correct any inaccurate or incomplete personal data.
- Right to Erasure (Right to be Forgotten): Client can request that Baleh Consulting delete their personal data, unless Baleh Consulting has a legal obligation to retain it (e.g., tax records).
- Right to Restrict Processing: Client can request that Baleh Consulting restrict the processing of their personal data (e.g., stop using it for marketing purposes).
- Right to Data Portability: Client can request that Baleh Consulting transfer their personal data to another service provider in a machine-readable format.
7. Data Retention
Baleh Consulting will retain Client data for a period of 10 years after the completion of the project. This timeframe allows Baleh Consulting to:
- Respond to any future inquiries from Client regarding the project.
- Comply with legal or regulatory requirements (e.g., tax regulations).
- Maintain a record of services provided for professional development and quality assurance purposes.
Baleh Consulting may securely erase or anonymise Client data after the retention period expires,
8. International Data Transfers
Baleh Consulting may transfer Client data to cloud servers located outside of the Client’s country of residence. These countries may have different data protection laws than the Client’s country. However, Baleh Consulting will take all necessary steps to ensure that Client data is transferred in accordance with applicable data protection laws and regulations. This may include implementing standard contractual clauses approved by regulators.
9. Children's Privacy
Baleh Consulting ‘s services are not directed towards children under the age of 18. Baleh Consulting does not knowingly collect personal data from children. If you are a parent or guardian and believe your child has provided personal data to Baleh Consulting, please contact us immediately. Baleh Consulting will take all reasonable steps to remove such data from its records.
10. Amendments to this Agreement
Baleh Consulting reserves the right to modify this Agreement at any time. Any changes will be posted on Baleh Consulting’s website and will become effective upon posting. Baleh Consulting will endeavour to notify Clients of any significant changes by email. Clients are encouraged to periodically review this Agreement to stay informed of updates.

12. Entire Agreement
This Agreement constitutes the entire agreement between Baleh Consulting and Client regarding the collection, use, disclosure, and protection of Client data. It supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
13. Governing Law and Jurisdiction
This Agreement will be governed by and construed in accordance with the laws of the state of SYDNEY. Any disputes arising out of or relating to this Agreement will be subject to the exclusive jurisdiction of the courts in that state or territory.
14. Severability
If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
15. Waiver
No waiver by Baleh Consulting of any breach of this Agreement shall be deemed a waiver of any subsequent breach. No failure or delay by Baleh Consulting in exercising any right or remedy under this Agreement shall operate as a waiver of such right or remedy.

Baleh Consulting’s website may use cookies and other tracking technologies, such as web beacons and analytics tools, to collect information about how visitors use the site. This information may include:
